There are five District Courts of appeal in Florida:
- The First District Court of Appeal located in Tallahassee
- The Second District Court of Appeal in Lakeland
- The Third District Court of Appeal in Miami
- The Fourth District Court of Appeal in West Palm Beach
- The Fifth District Court of Appeal in Daytona Beach
There are a myriad of types of Final and Non-Final Orders that can be appealed to the Appellate Courts. But not all Orders can be appealed. More importantly, there are strict deadlines to file an appeal. If you miss your deadline, you are barred from filing an appeal. Thus, you must act quickly.
What is the purpose of the appeal? It is our job to represent you and to persuade the Appellate panel of three Judges that the Trial Court made an error in law or fact. The focus of the appeal is articulately laid out through legal argument in an Appeal Brief. Oral argument is permitted if asked but is only granted on rare occasions.
The Appellate Court will review the decisions of the Trial Court to determine if reversible error has been committed. Such review involves the interpretation and application of the law to a given set of facts.
The Florida Rules of Appellate Procedure are complex. It is highly recommended that you retain experienced legal counsel to represent you throughout the appeal process.
One of the most common mistakes that an inexperienced attorney is thinking that a Motion for Rehearing/Reconsideration tolls the 30-day deadline to file an appeal. It does NOT. Please do not make this mistake.
