What happens when we get that call that a loved one can no longer take care of themselves financially and/or physically? Or even worse…what if someone is taking advantage financially or physically abusing someone we love? Caring for a loved one is something that we all do for family or friends at one time or another. 

If our family members do not have their estate plans in order – meaning, if they do not have a Power of Attorney nominating someone to make their financial decisions for them, or if they do not have a Health Care Surrogate nominating someone to make their medical decisions for them, then a Court will determine who will take care of them.

When Is Mental Health and Guardianship Litigation Necessary?

When a person lacks capacity to make their own medical and/or financial decisions and they do not have estate planning documents in place nominating persons to make said decisions for them, a Petition to Determine Incapacity, contemporaneously with a Petition for the Appointment of a Guardian over the person, must be filed in probate Court for a Judge to determine capacity and appoint a Guardian, should one need to be appointed.
